Recommendations regarding Chapter 5 of the Constitution of Georgia

The members of the Coalition discussed possible amendments to the Constitution of Georgia in the context of the constitutional reform. The Coalition’s recommendations regarding Chapter 5 of the Constitution concern the judicial branch of the government.

  1. The constitutional reform has to consider the issue of financing the judicial branch of government to allow the courts to carry out their constitutional functions independently and adequately. The level of finances allocated for the courts of general jurisdiction shall be reduced compared to the previous year’s budget only if there is a preliminary consent of the High Council of Justice and in the case of the Constitutional Court, the level of financing shall be reduced if there is a preliminary consent of the Constitutional Court of Georgia.
  2. The constitutional reform shall abolish the appointment of judges for a three -year probationary period.
  3. The constitutional reform shall change the procedure for the appointment of constitutional court judges based on the courts of general jurisdiction quota. The right to appoint 3 members of the Constitutional Court shall be transferred from the Supreme Court Plenum to the Conference of judges.
  4. The Constitution shall define the number of the Supreme Court judges.
